    Open Meetings Act Resolution to Determine Reasonable Notice

    Whereas, the Region 9 Coordinating Council (“council”) met in regular session at the Hotel Albuquerque at Old Town, in the Potters Room, 800 Rio Grande Ave. NW, Albuquerque, NM as required by law; and 

    Whereas, section 10-15-1(B) of the Open Meetings Act, NMSA 1978, sections 10-15-1 to -4 1979, (as amended through 2013) states that, except as may be otherwise provided in the constitution or the provisions of the Open Meetings Act, all meetings of a quorum of members of any board, council, commission, administrative adjudicatory body, or other policy making body of any state or local public agency held for the purpose of formulating public policy, discussing public business or for the purpose of taking any action within the authority of or the delegated authority of such body, are declared to be public meetings open to the public at all times; and

    Whereas, any meeting subject to the Open Meetings Act at which the discussion or adoption of any proposed resolution, rule, regulation, or formal action occurs shall be held only after reasonable notice to the public; and 

    Whereas, section 10-15-1(D) of the Open Meetings Act requires the council to determine annually what constitutes reasonable notice of its public meetings.

    Now, therefore, be it resolved by the Region 9 Coordinating Council that:

    All eleven (11) meetings will be at the Region 9 Education Cooperative, 143 El Paso Rd., Ruidoso, New Mexico 88345, at 9:00 a.m., or as indicated in the meeting notice.

    Regular meetings, unless otherwise specified, shall be as follows: July 18, 2018; August 15, 2018; September 19, 2018; October 17, 2018; November 14, 2018; December 12, 2018; January 16, 2019; February 20, 2019; March 13, 2019; April 17, 2019; and May 15, 2019. Notice requirements for these meetings shall be met if a list of regular meeting dates for July 2018 through June 2019 and this resolution are posted on the council’s website. This resolution will be e-mailed to those broadcast stations licensed by the Federal Communications Commission and newspapers of general circulation that have made a written request for notice of public meetings. The agenda will be posted on the council’s website at least seventy-two (72) hours prior to the meeting.

    Notice of regular meetings or committee meetings, not specified in paragraph two above, will be given ten (10) days in advance of the meeting date. For the purpose of these meetings, notice requirements are met if notice of the date, time, place, and the agenda, or information on how a copy of the agenda may be obtained, is posted on the council’s website. The notice will be e-mailed to those broadcast stations licensed by the Federal Communications Commission and newspapers of general circulation that have made a written request for notice of public meetings. If not included in the notice, the agenda will be available on the council’s website at least seventy-two (72) hours prior to the meeting.

    Notice of special meetings will be given three (3) days in advance of the meeting date. For purposes of special meetings, notice requirements are met if notice of the date, time, place, and agenda for the meeting, or information on how a copy of the agenda may be obtained, is posted on the council’s website. The notice will be e-mailed to those broadcast stations licensed by the Federal Communications Commission and newspapers of general circulation that have made a written request for notice of public meetings. If not included in the notice, the agenda will be available on the council’s website at least seventy-two (72) hours prior to the meeting.

    Notice for all emergency meetings will be given twenty-four (24) hours in advance of the meeting, unless threat of personal injury or property damage requires less notice. The notice for all emergency meetings shall include an agenda. For purposes of emergency meetings, notice requirements are met if notice of the date, time, place, and agenda for the meeting is posted on the front door of Region 9 Education Cooperative, 143 El Paso Rd., Ruidoso, New Mexico 88345. If possible, the notice, including the agenda, will be posted on the council’s website and e-mailed to those broadcast stations licensed by the Federal Communications Commission and newspapers of general circulation that have made a written request for notice of public meetings.

    In addition to the information specified above, all notice shall include the following language, “If you are an individual with a disability who is in need of a reader, amplifier, qualified sign language interpreter, or any other form of auxiliary aid or service to attend or participate in the hearing or meeting, please contact Bryan Dooley at (575) 257.2368 at least one (1) week prior to the meeting or as soon as possible. Public documents, including the agenda and minutes, can be provided in various accessible formats. Please contact Teresa Barnett at (575) 257.2368 if a summary or other type of accessible format is needed.”
